A will (formerly called a Last Will and Testament) is a legal document that outlines where or to whom you want your personal possessions and estate to be left to after your death. It can also include your wishes for your remains and/or a memorial.

Wills allow you to specify how you want your assets, including property, money, and personal belongings, to be distributed among your beneficiaries. It also allows you to name who you wish to be the legal guardian of any minor children.

  • Know that in BC you must be at least 16 years old and mentally capable to make a Will.
  • You need to designate an executor in your Will to oversee the distribution of your assets and ensure that your wishes are carried out at your end-of-life. This person handles the administrative and legal aspects of your estate. You may designate more than one person to help execute your will. Learn more from the Government of BC.

  • A Will must meet certain requirements to be valid, such as being signed and witnessed.  The original document should be kept in a safe place that can be accessed by your executor.  Electronic wills (e-wills) may be signed and stored digitally.

Things You Can Do

  • It is important to have a signed copy of your will. Your executor should know the location of your will and be notified if it is changed or updated at any time.
  • Review and update your Will periodically, especially if your circumstances change. 
  • Be aware of what can happen if you die without a will described by Nidus.ca.
