The Site, including all downloadable planners, trackers, forms, and tools, is provided solely for personal informational and organizational purposes. The Site and tools are not medical devices, diagnostic tools, clinical decision-support systems, or healthcare services, and are not intended to diagnose, treat, cure, monitor, or prevent any disease or health condition.

Restrictions on Use

The Site is for your use only. You agree to use the website and its content for personal, non-commercial purposes only and not for commercial, speculative, false, fraudulent, or illegal purposes.
You have a limited licence to print off or download copies of your Mywell Health fillable tools and planners, from our Site for your personal use or professional use. You may distribute such documents in their entirety including the Mywell Health Inc logo and website for educational purposes. Security and Passwords

When you use this Site, you will not need to identify yourself or use a username or password.

Security of Your Personal Data

Mywell Health Inc. does not collect any of your personal data. Users of the Site may download the tools and planners posted for their personal use. Once downloaded, the user can complete the fillable PDF and save it to their own devices. Mywell Health Inc. does NOT collect or download any personal information.

The security of your personal data is important to us but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal data, we cannot guarantee its absolute security.

Surveys

From time to time, we may offer you the opportunity to participate in one of our surveys. The information obtained through our surveys is used in an aggregated, non-personally identifiable form. We use this information to help us better understand our clients and improve our Site.

Warranty, Indemnity and Limitation of Liability

You agree to defend, indemnify, and hold harmless the Mywell Health Inc., its heirs, estate, successors, personal representatives, assigns, officers, directors, community contributors, volunteers, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to legal fees on a solicitor and his own client basis) arising from:

• your use of and access to the Site;
• your violation of any aspect of these Terms of Use;
• your violation of any third party right, including without limitation any copyright, property, or privacy right; or,
• any claim that through the use of the Site you caused damage to a third party. This defence and indemnification obligation will survive these Terms of Use and your use of the Site.

Termination

The Mywell Health Inc. may, in its sole discretion, cancel or terminate your right to use the Site or any part of the Site. In the event of termination, you are no longer authorized to access the Site or the part of the Site affected by such cancellation or termination. The restrictions imposed on you with respect to material downloaded from the Site and the disclaimers and limitations of liabilities set forth in this Agreement, shall survive termination of this Agreement. The Mywell Health Inc. shall not be liable to any party for such termination.

Waiver

Except as otherwise set forth in these Terms of Service, no failure to exercise, or delay in exercising, any right, remedy, power, or privilege arising from these Terms of Use operates, or may be construed, as a waiver thereof; and no single or partial exercise of any right, remedy, power, or privilege hereunder precludes any other or further exercise thereof or the exercise of any other right, remedy, power, or privilege.

Severability

If any term or provision of these Terms of Use is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of these Terms of Use or invalidate or render unenforceable such term or provision in any other jurisdiction.

Entire Agreement

Except as set out in any further written contract, The Terms of Use and our Privacy Policy constitute the sole and entire agreement between you and us regarding the Site and supersedes all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, regarding such subject matter.

Enurement

These Terms of Use shall enure to the benefit of and be binding upon each of the parties hereto and their respective successors and permitted assigns.
